临沂市郯城县公安局治安大队原副大队长徐某，因迷恋彩票，贪污、诈骗千万元，近日被法院一审以贪污罪、诈骗罪、贷款诈骗罪判刑20年，并处罚金60万元。

徐某1992年从部队退伍后，被分配到郯城县公安局工作。凭着满腔的热情，很快荣升为郯城县公安局治安大队副大队长。 5 |) b/ ^( B0 M1 b' V
% I. s* ]5 J1 Q$ K- b2003年，徐某开始玩彩票，经常拿出几元钱来“献爱心搞奉献”，同时也为了碰运气。买彩票的过程中，徐某有几次中奖。

! y5 b" |- r) j% \& R; f. w2004年10月，徐某买的彩票中了280万元大奖。中奖后的徐某非常兴奋，10万元买了一辆飞度轿车，10万元分期付款买了一套房子。剩余的钱，被他全部用来购买彩票。那段时间，徐某曾为彩奖兴奋得不能自持。徐某在供词中表示，此时他的脑海里装的全是彩票，上班时心不在焉，早晨第一件事想的就是去买彩票，下班后也是，甚至在睡梦中还在想着买彩票。

有了这次中奖经历，他买彩票也更加大胆，每次购买彩票的数额在几千元到几万元不等。很快，中奖的钱到了2005年底即被挥霍一空。

徐某在向警方的供述中表示，痴迷于买彩票是因自己有天赋。“有两次，我差一点就中了一千多万元的大奖。” 1 |# q' {* b2 L$ `6 }0 f& _& u
& X9 P( k1 c+ p3 h3 w: Q很不幸运的是，徐某所有的投入未换得回报。

8 e8 l3 L6 \ d+ a7 x: j: `. g从2006年到2007年两年间，他先后投入几百万元用来购买彩票。如此“大手笔”，正是徐某诈骗、贪污的非法所得。“我大都是以工程急需用款、滨河大道工程急用款等理由，并许以高额利息，从别人手里骗来的，不过我知道自己确实没有偿还能力……我知道这是犯罪行为……”徐某说。

据了解，早在2006年初，徐某买彩票已将手里的积蓄全部花光。他不甘心就这样“赔本”下去，于是想到了骗。截至案发时，他所“借”的款项已达55笔，1201.88万元。这些钱，主要用于购买彩票、私彩、DB或还欠账。

4 U' P1 o6 {2 w! x c& Q此外除了向私人借款，徐某还以各种不实的名义，共计在城区信用社等金融机构贷款214.5万元用于购买彩票以及进行投注非法私彩和网上DB。

) I" u$ I" I0 \$ r# |. Q2008年8月，徐某利用职务便利，将其负责查办的有关案件案款5万元，以“处理”的名义骗到手后，用于归还个人借款。 : U* m: i$ L- b! }
2 s0 o* X& z8 w2 {3 Y% o# j9 @+ J截至案发时，徐某仍有992.38万元个人借款、199.5万元贷款未归还。 % u4 O6 e/ T7 h* \5 x8 ^

还不起钱的徐某只能离家出走、远走高飞，与周围所有人断了联系。所幸的是，徐某的突然消失，加上不断有人反映徐某“借”了大量钱款，最终引起了公安机关的注意。在逃跑途中的徐某被警方缉拿归案。法院最终判定：徐某犯贪污、诈骗、贷款诈骗罪，判处有期徒刑20年，罚金60万元。 " ]+ E, N) U& C& ?5 s$ S
