7 K' _! e7 E! {3 _今年40岁的周某，隔三差五会去买几注彩票碰运气。2010年12月30日恰逢星期四，是福彩双色球开奖的日子，周某又来到平南县吴江路一个福彩投注站，花210元购买了一张双色球彩票。工作人员告诉他，广西福彩中心正在搞“福彩双色球，岁末再送车”活动，只要在活动期间购买单张金额20元及20元以上的福彩双色球彩票，可参与相应轮次和相应奖级的抽奖活动。一等奖为价值10万元的小汽车一辆。“说不定中大奖的就是你哦!”看周某买了彩票，有人这么打趣他。3 c# U d, l& L/ O9 g: ~
# q7 _+ z; q. n. h( e当天晚上双色球开奖，周某的彩票并没中奖。第二天，他就把彩票放在一边，忙自己的事情去了，也没太在意12月31日举行的抽奖活动。直到今年1月中旬，周某才意外得知，自己当时获得了抽奖活动一等奖。

买彩票居然抽中了价值10万元的轿车，周某十分高兴。今年1月15日，他持身份证和中奖彩票来到投注站，想进行登记确认。但当他表明身份时，投注站负责人的一句话让他的心凉了半截：“你已经超过了5日中奖确认登记时间，被视为弃奖，不能登记确认了。”9 |+ g, u7 a1 W+ ]. M% ?

B- R$ Z/ j5 V: i5月31日，记者在该投注大厅的喜报旁边看到了那张“福彩双色球，岁末再送车”的海报，上面印着笔记本电脑、液晶电视、电动自行车的奖品图片，海报下方有一辆银灰色轿车的图片。海报注明了活动时间、每轮抽奖奖品设置、参与条件、抽奖办法，以及中奖结果公布等内容，但并未明确公示兑奖期限，只是在海报右下角标注了一行小字：“详情咨询广西福彩投注站”。在广西福彩中心网站上，记者也找到了关于这项活动的通知。在网上的通知里，“中奖结果公布”一项中，多了“中奖者自中奖结果公布之日(以媒体公布日期为准)起5个工作日内，凭中奖彩票或手机号码和本人身份证，到广西福彩中心各区域管理处或各地市管理小组，进行中奖确认登记并领取奖品……一等奖中奖者需到南宁市葛村路23号广西福彩中心办理领奖手续。逾期没有进行中奖确认的视为放弃中奖权利。”的文字。7 D3 L. m8 X$ X7 j" k9 P0 k) l

7 c" h) T7 [# l& Z; h& n5月31日，原被告均未出庭，法庭上双方代理律师进行了激烈争辩，焦点主要集中在抽奖算不算彩票发行活动。

原告方诉称，广西福彩中心将兑奖确认登记时间限定为5个工作日，逾期不兑奖的做法，既不公平，也不合理，而且违反《彩票管理条例》和《天朝福利彩票“双色球”游戏规则》中兑奖期限为60个自然日的强制性规定，是单方确定的免除其责任，限制中奖人权利的霸王条款，对彩民没有约束力，被告应予兑奖，或按奖品价值兑付人民币10万元给原告。

被告广西福彩中心的代理律师辩称，“福彩双色球，岁末再送车”活动是具有公益性质的抽奖活动，并非《彩票管理条例》规定的彩票发行活动，所以主办方有权自行制定兑奖期限。抽奖活动于去年12月31日进行，今年1月2日，福彩中心依约将抽奖结果进行公告，并多次发出公告催促中奖者按时兑奖，已履行了自身义务。逾期兑奖的责任在于原告，后果应由他自己承担。
