以网络为载体，对欧洲足球联赛或美国NBA篮球联赛的结果下注进行网络Dubo，涉案赌资100万余元。近日，池州市贵池区人民法院对该案作出一审判决，以Dubo罪判处被告人徐某某有期徒刑三年、缓刑四年，并处罚金50万元；判处被告人龚某某有期徒刑两年、缓刑三年，并处罚金20万元。另外3名被告人霍某某、胡某、谷某某也分别获刑，并处罚金。
4 Z& ^; d# f. ~: p' h- H. e9 ? 法院审理查明，2010年1月，被告人徐某某提供博彩会员用户名、密码或电话，进行足球、篮球等赛事Dubo，赛后按照Dubo网站上开出的输赢、赔率等据实结算的方式进行兑付，总下注金额数十万元，徐某某个人所得2万余元。同年3月，被告人胡某介绍茹某至徐某某处进行网上Dubo。徐某某通过霍某某在澳门先获得Dubo网站，由胡某陪同茹某使用该网站进行网上Dubo，通过被告人霍某某工商银行账户进行买码转账。被告人徐某某非法获取“占成费”14万元、被告人胡某非法获得“洗码费”1.9万元。被告人谷某某、胡某采用同样方式让茹某在网上Dubo。茹某总计输了36万多元，胡某非法获得“洗码费”8500元，被告人谷某某非法获得“占成费”4.8万元。另外，2009年9月，被告人龚某某通过介绍茹某进行网上Dubo，获得5万余元的“洗码费”。5 F% X) t: r/ e g! h: e( `
法院审理后认为，被告人徐某某、龚某某等五人以营利为目的，明知他人实施Dubo犯罪活动，仍提供计算机网络、个人银行账户进行赌资转账等服务，均构成Dubo罪。 |
